EULA - End User License Agreement

End User Licensing Agreement
IMPORTANT READ CAREFULLY: This Art Plus End-User License Agreement (EULA) is a legal agreement between you and Art Plus Marketing Publishing for the Art Plus software. By installing, copying, or otherwise using the Software you agree to be bound by the terms of this EULA. If you do not agree to the terms of this Agreement, you are not authorized to use the Software.
The Software is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The Software is licensed, not sold.
1. Definitions:
(a) "Art Plus Software" means the software program covered by this Agreement, and all related updates supplied by Art Plus Marketing Publishing.
(b) "Art Plus Product" means the Art Plus Software and any related documentation, models and multimedia content (such as animation, sound and graphics), and all related updates supplied by Art Plus Marketing Publishing.
Upon acceptance of this agreement, Art Plus grants to you a non-exclusive license to use the Software, provided that you agree to the following:
2. License Grant:
You may install the Software on a hard disk or other storage device and make backup copies of the Software. This License does not entitle you hard copy documentation, support or telephone assistance. Art Plus reserves the right to alter prices, features, licensing terms, or other characteristics of this Software.
COPYRIGHT. All title and copyrights in and to the Software and any copies thereof are owned by Art Plus or its suppliers.
3. Refund Policy:
Software License is not a tangible good that you can return to the seller for a refund. Once the unique license code has been dispatched the purchase is final!
There may be exceptions to the rule. Therefore, refunds will be handled on case by case basis. Before eventually issuing a refund, Art Plus Support will try to understand the problem and will try to assist the user to solve the problem. In case Support efforts fails, Art Plus at it's sole discretion may issue a refund. To be eligible for a refund you must participate in Support efforts to solve the problem by providing detailed information about the problem.
4. Restrictions:
You agree not to modify, adapt, translate, reverse engineer, decompile, disassemble or otherwise attempt to discover the source code of the Software. You may not modify, rent, resell, distribute or create derivative works based upon the Art Plus Product or any part thereof.
5. Disclaimer of Warranty:
This software is provided on an "as is" basis, without warranty of any kind from Art Plus. Any use of the Software is at your own risk. To the maximum extent permitted by applicable law, Art Plus and its suppliers disclaim all warranties and conditions, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non infringement.
The entire risk as to the quality and performance of the software is borne by you. Should the software prove defective in any respect, you and not Art Plus or its suppliers assume the entire cost of any service and repair.
This disclaimer of warranty constitutes an essential part of the agreement. No use of the software is authorized hereunder except under this disclaimer.
6. Privacy:
If you decide to register the product, you will be entitled to support and can opt to receive occasional announcements about Art Plus products. In that case your address will be added to Art Plus mailing list. Art Plus will not resell this information to third parties, and you will always be able to unsubscribe.
7. Termination:
This Agreement and the license granted hereunder will terminate automatically if you fail to comply with the limitations described herein. Upon termination, you must destroy all copies of the Software and Documentation.
8. General:
This Agreement shall be governed by the laws of the Republic of Croatia. This Agreement contains the complete agreement between the parties with respect to the license granted hereunder and supersedes all prior or contemporaneous agreements or understandings, whether oral or written.
This Agreement may be amended only in writing signed by an authorized officer of Art Plus. If any provision of this Agreement is held to be void and unenforceable, it will not affect the validity of the balance of the Agreement. Such provision shall be reformed only to the extent necessary to make it enforceable. This Agreement shall be governed by Croatian law, excluding conflict of law provisions (except to the extent applicable law, if any, provides otherwise).
